Qualifying days regarding Statutory Sick Pay and Part Time Workers

Although we never profess to be payroll experts (we do know someone who is, so don’t worry!) we do occasionally get payroll related queries, as we did here – we thought it was worth sharing since most clients we work with now have part time workers and when sickness unfortunately arises this could affect them.

 

Q - Our part time worker who works Mon, Weds, Fri thought that the 3 ‘waiting days’ when she was off sick included her non-working days. Help?!

 

A: The “Qualifying days” for SSP purposes are her normal working days so she would have to have a full week off on sick leave i.e. including her 3 normal working days of Mon, Weds and Fri as it happens here, for the 3 waiting days to be ‘used up’ before she started to receive SSP from the following Monday.

 

On a related matter re a payroll query that we also had last month:

 

Q: What happens when an employee is on sick leave and receiving SSP and the employer decides to terminate their employment in the circumstances and pay in lieu notice of termination (make sure the contract gives the right to make a PILON of course!)?

 

A: Basically the employer should make their notice pay up to their normal pay i.e. SSP amount plus the difference to ensure their pay the same as it would normally have been.
