Following on from last month’s query about someone taking the time off despite the holiday request being turned down, we received another holiday related query.

 

Q: We have an employee who has just notified us she has a serious food poisoning/ stomach bug two days before she was due to go on holiday on the Monday and she’s now asking for her absence to be classed as sick leave. I do think it’s genuine but should we change this to sick leave as she’s requesting?

 

A: She has let you know as soon as possible and if you think it’s genuine you should allow her to take her holiday at another time. It doesn’t sound like she’ll be off too long anyway but note that if the illness was more serious and she remained off sick until the end of the holiday year, she could carry over her holiday in the following year.

 

As the holiday leave is now classified as sickness absence she will be given sick pay rather than her normal rate of pay.

 

Bear in mind that if she had gone on holiday and then fell sick whilst on holiday, provided it is notified correctly, that period of time will also be treated as sickness absence.

 

Both these scenarios can be covered off in your holiday section of the contract or staff handbook.
